This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may change this Privacy Policy from time to time. Any such changes will be posted on the Website. If we make any material changes, we will notify you by email (sent to the email address specified in your account) prior to the changes becoming effective. By accessing the Website and/or using the Services after we make any such changes to this Privacy Policy, you are deemed to have accepted such changes. Please be aware that, to the extent permitted by applicable law, our use of the Information is governed by the Privacy Policy in effect at the time we collect the Information. 3. Information We Collect

In the course of operating the Website and the Services, Wholier may collect (and/or receive) the following types of information. You authorize us to collect and/or receive such information.

Account Information

When you create an account (“Account”), you will provide information that could be personally identifiable information (“Personal Information”), such as your name and email address. You acknowledge that by creating an account on the Services and providing Personal Information to us, you allow us, and others, to identify you. We may use your contact information to send you information about our Services. You may unsubscribe from marketing messages through your Account settings or the unsubscribe link in any such email; we may still contact you for non-marketing reasons (for example, to confirm an order or for account recovery).

User Content and Testimonials

Some features of the Services may allow you to provide content (“User Content”) to the Services, such as written comments and testimonials. All content submitted by you to the Services may be retained by us for as long as commercially necessary, even after you terminate your account. We may continue to disclose such content to third parties, as described in this Privacy Policy.

Billing Information

If you purchase products through the Services, your financial information — such as your credit card number, expiration date, security code, billing zip code and similar information (collectively, the “Billing Information”) — is collected and stored by our third-party payment processors (each, a “Third-Party Payment Processor”), and use and storage of that information is governed by the Third-Party Payment Processor’s applicable terms of use and privacy policy. We use Stripe (www.stripe.com) as our payment processor for one-time purchases and Recharge, Inc. (www.rechargepayments.com) to manage subscription billing. To facilitate your order transactions, we collect and store your credit card expiration date and the last four digits of your credit card number, but we do not store your full credit card number or security code on our own servers.

Shipping Information

When you order products using the Services, we request and store your shipping information (“Shipping Information”). We share this information with our Third-Party Payment Processors, fulfillment companies, partners and other third parties for purposes of customer service and order fulfillment. Use of your information by such parties is governed by their respective privacy policies.

SMS/Text Message Information

If you opt in to our SMS program, we collect your mobile phone number, your consent records (including the date and method of opt-in), and information about messages we send you and your responses (such as opt-outs and replies). Our SMS program is powered by Recharge, Inc. We share your phone number and message data with Recharge and our wireless carrier service providers in order to deliver messages to you. For more details, including how to opt out, see Section 10 (SMS/MMS Mobile Message Marketing Program Terms and Conditions) of our Terms of Use.

Information Collected Automatically

In an ongoing effort to improve the Website and the Services, we automatically collect certain information (“Other Information”) when Visitors visit the Website and when Customers use the Services. Such information includes, without limitation, your Internet Protocol (IP) address (the number automatically assigned to your computer whenever you access the Internet, which can sometimes be used to derive your general geographic area), approximate geolocation information derived from your IP address, browser type and language, operating system, device identifiers, referring and exit pages and URLs, date and time, amount of time spent on particular pages, what sections of the Website Visitors visit, and similar information concerning your use of the Services.

Cookies and Similar Technologies

We collect information using “cookie” technology and similar technologies such as pixel tags, web beacons, software development kits (SDKs), and local storage. Cookies are small packets of data that a website stores on your device so that the device will “remember” information about your visit. We may use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your device until you delete them) to help us collect information and to enhance your experience using the Services.

Pixel tags (also called “beacons” or “clear gifs”) are transparent graphic images placed on a web page or in an email that, in combination with cookies, allow for the collection of information regarding the use of the page or email. We use pixel tags to tell when an ad or email has been opened, viewed, or clicked, and to judge which ads or emails are more effective.

Third-Party Analytics

We may use one or more third-party analytics services (such as Google Analytics) to evaluate your use of the Services, compile reports on activity, collect demographic data, analyze performance metrics, and collect and evaluate other information relating to the Services and mobile and Internet usage. These third parties use cookies and other technologies to help analyze and provide us the data. Third-Party Advertising Companies

We may permit third-party online advertising networks, social media companies and other third-party services to collect information about your use of our Website over time so that they may play or display ads on our Website, on other devices you may use, and on other websites, apps or services, including platforms like Meta (Facebook and Instagram), TikTok, Pinterest, and Google. These third parties may use cookies, pixel tags, SDKs, and similar technologies to collect this information. Some of these activities may be considered “sales” or “sharing” of personal information, or “targeted advertising,” under U.S. state privacy laws. You may also opt out of interest-based advertising by visiting the Network Advertising Initiative (http://www.networkadvertising.org/choices) and the Digital Advertising Alliance (www.aboutads.info/choices), and by adjusting your ad preferences directly within platforms like Meta, Google, and TikTok. These opt-out tools are provided by third parties; we do not control or operate these tools.

Email Communications

We may receive a confirmation when you open an email from us or click on a link in an email. We use this confirmation to improve our customer service and to measure the effectiveness of our communications. If you do not want us to send you marketing or promotional email communications, you can opt out by clicking the “unsubscribe” link in any such promotional email, by checking the relevant box on a form on which we collect your data, or by emailing us at hello@livewholier.com.

4. How We Use Your Information

We use the Personal Information, Billing Information, Shipping Information, SMS information, and Other Information we collect (collectively, the “Information”) for purposes including:

      Providing the Website and Services, including processing and fulfilling orders, managing subscriptions, providing customer service, and administering your Account;

      Communicating with you about your orders, Account, subscriptions, and customer service requests;

      Sending you marketing emails and, if you have opted in, SMS messages about our products, promotions, launches, and events (you can opt out at any time as described above);

      Personalizing your experience and the content and offers we show you;

      Measuring, analyzing, and improving the Website, the Services, and our marketing;

      Detecting, investigating, and preventing fraud, security incidents, abuse, and other unlawful or harmful activity, and enforcing our Terms of Use;

We do not use sensitive personal information (as defined under applicable U.S. state privacy laws) for purposes that would require us to offer a right to limit such use beyond what we already provide in this Privacy Policy.

5. How We Share Your Information

You authorize us to use the Information to provide and improve the Website and the Services; to solicit your feedback; and to inform you about our products and services and those of our promotional partners. We share Information as described below.

Service Providers

We engage other companies and individuals to perform certain business-related functions on our behalf. Examples include payment processing (Stripe, Recharge), order fulfillment and shipping, hosting and infrastructure, customer service, analytics, email and SMS delivery, advertising, and other technical services. These service providers have access to the Information only as necessary to perform their functions and are required to protect the Information consistent with this Privacy Policy and applicable law.

Aggregate and De-identified Information

We may analyze Personal Information together with Other Information in anonymized, de-identified, or aggregate form (“Aggregate Information”) in order to operate, maintain, manage, and improve the Website and the Services and for our own research purposes. Aggregate Information is not personally identifiable, and we will maintain and use such information only in de-identified form.

Advertising and Analytics Partners

As described in Section 3 (Cookies and Similar Technologies; Third-Party Advertising Companies), we share certain online identifiers and usage information with advertising and analytics partners to deliver and measure advertising and to evaluate site performance. Some of this sharing may be considered a “sale” or “sharing” of personal information, or “targeted advertising,” under U.S. state privacy laws. Legal Requirements and Protection of Rights

Wholier may disclose Personal Information or other information about you in response to (a) requests from local, state, federal, or international law enforcement officials; (b) any judicial, administrative or similar proceeding or order, such as a subpoena; (c) if required by law; or (d) to investigate suspected fraud, harassment, physical threats, or other violations of any law, rule or regulation, the Website rules or policies, or the rights of third parties, or to investigate any suspected conduct which we deem improper.

Corporate Transactions

If we sell all or part of our business, or make a sale or transfer of assets, or are otherwise involved in a merger, reorganization, financing, or business transfer, or in the event of bankruptcy, we may transfer your information to one or more third parties as part of that transaction. You will be notified via email and/or a prominent notice on our Website of any change in ownership or material change in uses of your Personal Information, as well as any choices you may have regarding your Personal Information.

With Your Direction or Consent

We may share your information with other third parties when you direct us to do so or otherwise consent to the sharing.

6. Information Security

We are committed to protecting the information we receive from you and have undertaken commercially reasonable administrative, technical, and physical safeguards designed to prevent unauthorized access to data we maintain. However, due to the inherent open nature of the Internet, Wholier cannot ensure or warrant the security of any information you transmit to us or any information provided online, and you do so at your own risk. Customers and Visitors must accept all risks associated with any data transmission, including the risk that their Personal Information may be intercepted in transit. In the event that personal information is compromised as a breach of security, Wholier will notify affected individuals in compliance with applicable law.

7. Data Retention

We will retain your information for as long as your Account is active or as needed to provide you Services. We also retain and use your information as necessary to comply with our legal obligations (including tax, accounting, and consumer protection laws), resolve disputes, enforce our agreements, and for legitimate business purposes such as fraud prevention. When information is no longer needed for these purposes, we will delete or de-identify it. If certain information has already been provided to third parties as described in this Privacy Policy, retention of that information will be subject to those third parties’ policies.

You acknowledge that Wholier may establish general practices and limits concerning use of the Services, including without limitation the maximum period of time that data or other content will be retained by the Services and the maximum storage space that will be allotted on Wholier’s servers on your behalf. We will endeavor to give you notice of any material change to these practices where required by applicable law.

8. Accessing and Updating Your Information

If you are a Customer, you may access and update your registration information associated with your Account by logging into the Services. Visitors and Customers can access and delete cookies through their web browser settings.

Should you decide to delete your Account, you may do so by emailing us at hello@livewholier.com. If you terminate your Account, any association between your Account and information we store will no longer be accessible through your Account. However, any public activity on your Account prior to deletion will remain stored on our servers and will remain accessible to the public unless you have a right to require its deletion under applicable law (see Section 9).

9. Your U.S. State Privacy Rights

Depending on the U.S. state in which you reside, you may have specific rights with respect to your personal information under state privacy laws, including the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA/CPRA”), and similar laws in Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Iowa, Delaware, New Jersey, Tennessee, New Hampshire, Minnesota, Maryland, Indiana, Kentucky, Rhode Island, and other states (collectively, “State Privacy Laws”). We collect personal information from you directly (when you register, place an order, or contact us), automatically (through cookies and similar technologies), and from service providers and partners (such as our payment, fulfillment, analytics, and advertising providers).

We use personal information for the business and commercial purposes described in Section 4 (How We Use Your Information). We do not sell personal information for monetary consideration. However, our use of cookies and similar technologies for advertising and analytics may be considered a “sale” or “sharing” of personal information for cross-context behavioral advertising, or “targeted advertising,” under State Privacy Laws.

We do not knowingly sell or share for cross-context behavioral advertising the personal information of consumers under 16 years of age.

We do not collect or process “sensitive personal information” for the purpose of inferring characteristics about you, beyond what is necessary to provide the Services and as otherwise permitted under State Privacy Laws without an opt-out.

Your Rights

Subject to certain exceptions and the specific law that applies to you, you have the following rights:

      Right to know / access. Request that we disclose what personal information we have collected about you, the sources, the purposes, and the categories of third parties with whom we have shared it.

      Right to correct. Request that we correct inaccurate personal information we maintain about you.

      Right to delete. Request that we delete personal information we have collected from you.

      Right to portability. Request a copy of your personal information in a portable, readily usable format.

      Right to opt out of sale or sharing / targeted advertising. Direct us not to “sell” or “share” your personal information or use it for targeted advertising.

      Right to limit use of sensitive personal information. Where applicable, limit our use and disclosure of sensitive personal information to certain permitted purposes.

      Right to non-discrimination. You will not receive discriminatory treatment for exercising your rights, including denial of service or different prices.

How to Exercise Your Rights

To exercise any of these rights, please contact us at hello@livewholier.com with “Privacy Request” in the subject line, or use the “Do Not Sell or Share My Personal Information” link in the footer of our Website. We will need to verify your identity before fulfilling certain requests, which may include asking you to confirm information we already have about you.

You may use an authorized agent to submit a request on your behalf. We will require written proof of the agent’s authority and may also need to verify your identity directly.

Opt-Out Preference Signals

We honor opt-out preference signals (such as the Global Privacy Control, or “GPC”) sent by your browser or device for residents of states whose laws require us to do so. When we detect a GPC signal, we will treat it as an opt-out of “sale,” “sharing,” and targeted advertising for the browser or device on which it is enabled.

California “Shine the Light” Notice

Under California Civil Code Section 1798.83 (the “Shine the Light” law), California residents who have an established business relationship with Wholier may request, once per calendar year, information about the categories of personal information (if any) we shared with third parties for those third parties’ direct marketing purposes during the prior calendar year, and the names and addresses of those third parties. California Minors

If you are under 18 years of age, reside in California, and have a registered account on the Website, you have the right to request removal of unwanted content that you have publicly posted on the Website. To request removal of such content, please contact us using the contact information above and include the email address associated with your account and a statement that you reside in California. We will remove the content from public display, but please note that the content may not be completely or comprehensively removed from our systems.

10. Children’s Privacy

The Website is not intended for persons under the age of 13, and we have no intention of collecting or soliciting Personal Information from persons under the age of 13. If you are not 13 or older, you are not authorized to use the Website. Parents should be aware that there are parental control tools available online that you can use to prevent your children from submitting information online without parental permission or from accessing material that is harmful to minors. If a child under age 13 has provided us with Personal Information, we will use all reasonable efforts to delete such information from our database. We do not knowingly process the personal information of consumers under the age of 16 for purposes of “sale,” “sharing,” or targeted advertising under State Privacy Laws.

The Website and the Services may contain links to External Websites. These External Websites are not controlled by Wholier. We encourage our Customers and Visitors to be aware when they leave our Website and to read the privacy policies of every website that collects personally identifiable information. We do not endorse, screen or approve, and are not responsible for, the privacy practices or content of such External Websites.

12. Social Networking Services

The Website and the Services may allow you to post information to various third-party services or platforms, such as social networking services like Instagram, TikTok, X (formerly Twitter), and Facebook. You acknowledge that if you choose to use this feature, your friends, followers, and subscribers on these third-party services or platforms will be able to view such activity. If you choose to access or make use of third-party social networking services, we may receive information about you that you have made available to those social networking services, including information about your contacts on those social networking services. The use of the information by such social networking websites will be governed by their privacy policies, and we do not control their use of the shared data.

13. Notice to Non-U.S. Residents

The Website, the Services, and their servers are operated in the United States. If you are located outside the United States, please be aware that your information may be transferred to, processed, maintained, and used on computers, servers, and systems located in the United States and other countries where the privacy laws may not be as protective as those in your jurisdiction.
